BREAKING NEWS: 1st Cell Phone Ordinance in US Now in Effect in San Francisco
The first cell phone ordinance in the U.S. is now in effect in San Francisco, CA. Retailer compliance is required by the end of October. The ordinance (11-07-CPO) requires consumer education at point-of-sale recommending: 1) limiting cell phone use by children, 2) using headsets or speaker phones, 3) keeping the phone away from the body, 4) avoiding areas with weak signals where the phone uses more power and 5) reducing the frequency and length of calls. This regulation repeals previous regulation SFE 10-03-CPO, and specifies the content and format of materials to be posted and distributed at retail locations. The earlier proposed regulation was stalled due to a lawsuit by the cell phone industry, but the new language sailed through to passage and has been signed into law.

IMPORTANT UPDATE: The CITA (cellphone industry association) has filed a lawsuit in San Francisco against the newly implemented cell phone Right to Know Ordinance, saying the new law violates 1st Amendment rights. Essentially, they say with the right to know ordinance they are being forced to say something they don’t want to say, and that the new San Francisco law is preempted by federal law The hearing in San Francisco will be before Judge William Alsup on October 20. It was reported that CTIA had no comment but City Attorney Dennis Herrera, who is running for Mayor, said, “Freedom of speech is about encouraging the exchange of ideas, not about keeping people in the dark about vital health information”.
